CREATIVE CONTRIBUTOR AGREEMENT
I am submitting written text, photographs, and/ or graphic works created by me (hereafter called “Materials”) for publication on vivaglamamagazine.com, which is owned and operated by KVD Brand, Inc dba VIVA GLAM Magazine, (hereafter called “publisher“).
By submitting content to publisher, I assign and convey to publisher a perpetual, royalty-free, irrevocable, and non-exclusive right and license to use, edit, alter, copy, store, post, publish, transmit, communicate, publicly display and perform, distribute, promote, advertise, and create compilations and derivative works of the submitted content or any creative aspect thereof, in any medium which currently exists or which may be developed in the future. I am aware that I may request, in writing, to cancel my submission to publisher anytime prior to publishing. Once published, the retraction of Materials will be at the discretion of publisher.
I hereby warrant and convey that the Materials submitted to publisher are my own and have not been reproduced or plagiarized in any way. All text, images, or graphics submitted that are not created by me, shall be accompanied by written permission to publish from the proper owner of such rights. Publisher has sole discretion as to what Materials are published; the combination of images, videos, and articles published; and maintains the right to not publish all or any part of Materials.
In furtherance of the foregoing, I agree that I will not: (a) submit material that is copyrighted, protected by trade secret, or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless I have written permission from the rightful owner to grant publisher all of the rights granted herein; (b) publish falsehoods or misrepresentations; (c) submit advertisements or solicitations of business.
I understand that my name will not be credited until publisher has published at least 2 of my submissions. At the time my third submission is approved, my submissions, including previous posts, will be credited with an appropriate and publisher approved photo and short bio. I will be responsible for providing my picture(s) and short bio.
I hereby release, discharge, indemnify, and agree to hold harmless publisher, her/his heirs, legal representatives, or assigns, and all persons functioning under her/his permission or authority, or those for whom she/he is functioning, from any liability claims whatsoever in connection with the use of Materials, including but not limited to, libel, slander, copyright infringement, unfair competition, endorsement, trademark infringement, or dilution.
Should publisher receive a request for correction or retraction based on Materials provided by me, I agree that publisher has sole discretion as to the steps and procedures taken to resolve the request or claim, and I agree to hold publisher harmless of any resolution publisher deems appropriate. I further agree to cooperate and assist publisher in information gathering relevant to processing such a request.
I understand that I am submitting work(s) on my own accord and without promise to if my submission will be selected for posting. I further acknowledge that the sole consideration, if any, for the publication of my submitted work(s) is the exposure I
may receive for having my article published (posted) and hosted by publisher
and that I am not owed or due any compensation by publisher.
I have read and understand this agreement, and I accept and agree to all of its terms and conditions. I enter into this agreement voluntarily, with full knowledge of its effect.
